So here goes Guys : We moved our shop/store about three Months back to a different Industrial complex as most everyone knows . These Places have a kind of "life of thier own" to set the stage ... So today I'm strolling thru the parking lot to my mail box , when I see this rather large mangy ass dog coming towards me Although I'm a dog owner (big Golden ones) and I like dogs I have great respect for unknown dogs and try to be very carefull around them .... so I continue on to the box keeping an eye on him , all of a sudden the SOB dog struts up and bites me on the right arm thru my jacket ! I say WTF and pull my arms in close to my body Then he bites me on the back of a calf and my left hand (bruised but didn't break the skin ) by now I'm a little freaked & intimidated so I yell out to the shop where the mutt "belongs" . The Dog and shop owner comes out and takes the dog away to chain him up then comes back doesn't appologize and says "next time he does that just smack him" (the dog is around 90 lbs) I say I was looking for a board or ?? to do just that ! he says "oh I don't want you hitting my dog with a board" I'm thinkin "whats wrong with this picture ?? I'm supposed to wonder when and if this dog will bite me again (or one of my family or customers, huge liability issue) And heres this dumb ass making me feel bad that his dog (not supposed to be there anyhow) might be in danger from me ? this guy should be begging forgivness right now I say next time I'll call animal control he says "Oh so thats how you roll huh" Then to make matters worse he says "This is "XYZ industrial Park were a big family and you need to conform" (or something like that) ensenuating that we weren't part of the click yet? Here the point #1Business's and Dogs just don't mix IMO #2 Had this been me I would have been asking this guy if he was ok and appologizing up the gazzoo #3 When I called the Buildingsuper he says "Oh yeah that dog is a little rambunctious .........Any thought Folks ? guess its ok for peoples dogs to run up and just bite people now a days...screw him i would call animal control and have the dog "quarantened" spelling i know...its one thing if you were trespassing, but its another for a dog to come up and just bite you...i know this sounds bad but i learned a long time ago that is being attacked by dog a good solid kick in the throat will drop it dead, and i will live by that...im not saying i would go out and do that to any dog, but your right what if it was a customer or a kid or something rather...i would handle the situation before it gets worse...even though it is a catch 22 because now you are pissing of other tennants, but maybe your other tennants dont like the dog either, and are too scared to say anything...in all reality i dont think a situation like this should be taken lightly

Good advice , it is however that "fine diplomatic line" we walk in a situation like this I told him if the dog came near me again I'd call animal control That really pissed him off

call animal control anyway, if it bites 1 of your customers and you knew it bit previously I think you might be liable if you had done nothing. Also consider having your lawyer (I hear everyone in California has 1 ) send a letter to the landlord or strata council or whoever is at the top of the pile and threaten them if the dog is not controlled. you might not be the only one that dislikes the situation

I have owned dogs all of my life in fact I love dogs, I'm like you, I get nervous when the hair on my dogs back raises at anyone....
Here is my take.
That is a POS animal owner. I would start a paper trail right now. That dog is going to hurt someone, maybe not today or tomorrow, but someday. I would write a letter including pictures of any damage to you or your jacket and send it to the building owner (ultimately he will also be responsible) and keep a copy on file at your house, be sure to write on the bottom "CC: Tom XXXXX at JBP"
This does a couple of things...
1. it starts the communication between the building owner and the irresponsible ass that has a dog :sly:
2. if this happens again to you, your customers, or a member of your family, there are no more conversations needing to be had. It's lawyer time, period end of story..
BTW, I had a dog at my shop, if he does not have a "Beware of Dog" sign and the animal in question not liscensed (including vaccinations), he is in direct violation of numerous laws including State laws which are strictly enforced..Animal control will take the dog in a New York minute at great expense to the owner.
I cannot stand loser animal "owners", I wish they did not exist. :thumbdown:

Just kidding that does suck its a shame some poeple just dont care about others somthing should be done if my dog was to bite someone i would take care of it myself on the spot you do need to do somthing to protect your family and customers hope your ok bud >:( now you know you just had a birthday not to long ago and at your age healing may take a little longer so hang in there grampa lol

Bad situation there Tom. Dunna what to tell you. I normally carry around here, and I, personally, may well have escalated things a bit more with a .45 ACP round to its head out of fear, had I been attacked like that. Dunno for sure, never happened to me. You guys and gals in 'Fornica don't have that right, unfortunately. (Confrontation with the owner woulda been much more 'awkward' in that case).
I too love dogs, but theres a line between loving dogs and what a lot of owners allow their animals to get away with.
I'd certainly get it looked at and send the bills to his address, and file a police report about it. That's just me. You'd feel guilty as hell to find out later, if you ignore it, and have some kid get mauled by the beast. Just my opinion.

Tom, even if he wasnt an arrogant ass hole, that dog needs to be under control not roaming around as it pleases !!! I'm sure this isnt the first time its done something like this (and wont be the last). We all know I'm a dog lover, but there is NO WAY I would let my dog roam around loose like that. Its irresponsible and asking for trouble. You need to not be worried about the owners attitude, or if it would bite one of your customers, but think about what would have happened if it was one of your grand kids out there playing !!! A 90lb aggressive dog should NEVER be roaming around as it pleases !!!!!! If you ever see that dog loose again call animal control immediately !!

A friend of mine whoes a retired cop now had to drop a dog in his driveway. The thing wouldnt let them out of the house. Maybe you should get a big ole gnarly pitbull/mastif with aids and let it intimidate "Goldie" and his owners?

Contacting his Insurance is the BEST idea I have herd yet!
The owner of my duplex came by a couple of weeks ago and said his insurance would not allow pitbulls in any tenants houses or they would drop him as a insured. I convinced him my dog was a boxer/choclate lab and he fell for it.
Insurance companies are very strick when it comes to dogs! I know my wife is a liscensed insurance broker!

And considering that it is Xmas time, I imagine all the stores can get you a good deal on a nice Louisville Slugger. Keep it with you every time you go out to check the mail.
Sage advice (on the bat ;) ) This morning I got a breif letter of appology from this guy , what I want is reasonable assurance that the mutt will stay home or on a chain or ?? , It wasn't so much for me about the incident as it is IMO unproffesional to have a Dog or Dogs roaming around unattended in a complex such as this I admitt its kind of cool and laid back but more and more at least around here people have thier dogs, large and small everywhere , Home depot , Longs even the Super Market You just flat need to be responsible and if not Dont own one

I would just find a boat with blown 600+ inch dry stacked motor in it a fire it up all day everyday until he moves out of the complex. Just my .02 Matt

I do it EVERY day Tom. We used to tolerate it only because our customer base is primarily from local retirement communities. And you KNOW how grumpy old people can get about their lil Poodles and Pomeranians! Have to. Had an incident one evening with a customer bringing in an English Mastif that Terry mentioned (Thing was the size of a Shetland Pony, I swear), and just the sight of it scared this little woman at the paint counter and her two very small children into hysterics and tears. The kids were shaking, they were so scared. gave them all candy and sodas to calm them all down after I got rid of the "dog" (More like a Sasquatch).
Dog was nice and friendly, but that incident makes me be an a$$hole to every little old lady in Chandler (or so my reputation seems to be). I have to do it.
I get called everything but a White Boy, and told "I'll never shop HD again", etc, etc. Got written up once by the DSM for replying to this old phucker "Can I have that in writing........." Guess I'm not allowed to say that, or supposed to admit I DID say it, ::)
But wheres the line? Either all or none when it comes to that. There is NO grey area. I beleive there are Health Code violations for allowing non-essential animals in food service areas (Such as restaurants) Would that not ALSO apply to most grocery stores? Just thinking out loud.......

If the store allows the animals and makes no effort to remove from the store, the store is in violation of their health permit hanging on the wall.
When my DM got those complaints because I kicked a women out whos bird, yes bird was shitting on my stores floor and the women could of cared less, I quickly pointed out that 20% of our sales were generated from the piece of paper on the wall...I won!

UPDATE ! The guy with the pooch , got my letter (both fax and email) This morning he appologized (humblely and sincerly PLUS he bought me a 12 pack of Bud bottles as a peace offering ,he said he had a really bad day and sincerley rgretted the incident He also prommised to keep the mutt at home from now forward The landlord stopped by to say that he had just lost to renters (due to the economy) and hoped all was well This was a much better ending than I expected Thanks for all the help and support ! like said it really wasn't about the bites it was about the guys shitty attitude Tom

Thanks , sadly I think the "cc" to my corp attorney may have had some effect on his attitude adjustment but the Beer WAS a nice jesture . Much rather get along than to live/work in a shitty atmosphere

Dang Tom, thats crazy. Lucky for his dog it wasn't me. You know me, I'm always packin my pistol, I would have shot that dog. Anyway, glad it worked out.
On a side note, as to the blown 600ci noise suggestion, The neighbors probably wouldn't notice with all the Harleys in back lol.
