OK I trust you guys to be the objective judges and I want you to be objective here I'll try to present this as best I can without prejudice... I'm alotted about 10 parking spots + or - as you can see from the picture the boats (on trailers) are neatly lined up and organized anybody thats been to JBP knows were are neat clean and organized , I've been here for 14 years same operation same Landlord (nice guy ,a little ecentric) soooooo, a few weeks ago he calls me aside to tell me he's "a little pissed" he's got a fairley significant DENT in the rear roll pan below his rear bumper on his "Burb" I says "geeee doc bummer what happened " (Docs angry ,he says "I backed into one of your trailer hitch heads the other nite" (or words to that effect) I say hmmmm did you damage my trailer?? (didn't laugh) Heres the point , if the trailer in question was out in the middle of the lot in the dark ,one thing , but.... it was in a dedicated parking spot where I've parked boats (with trailers for freekin 14 years ) My opinion ,shame on you ,you run/back into my trailer and f*ck your vehicle up "your bad" , if I'm neligent and leave something out you couldn't anticipate or suspect "my bad" Well whats the vote come'on I can take it ! ?? Tom, as you already know I was in the "Biz" for several years, so that being said, "technically" the landlord is correct, parking spaces are dedicated for "motor vehicles" and not trailers, that will actually be in the zoning laws, however, the trailer was there before the "Burb", so his bad for running into it, when I had my shop, I had to "Rope off" boat trailers and boats on trailers that were parked in the complex parking lot if not attatched to a "motor vehicle", I really want to say it was because of the insurance company that I found all of this out...(the trailer of a boat does not carry liability insurance like a "motor vehicle"), it may have something to do with a scenario that if the trailer was not properly chocked, it could hit something and cause damage to personal property..Just my opinion based on being screwed in the past... :banghead:
Personally, if he hit a trailer, he would have hit a Ferrari, soooooo who's wrong????? ??? ^-^
On another note....FYI, if you have a customers boat out front and not "behind a closed door" and that customer owes you "fix it dough", they can show up with an officer of the law and hook up and go, legally.... because it is not "secured" and it is his/her personal property...Been there done that. :banghead: ....(only made that mistake once ;) )

The only way I read it is it's the Landloard's fault.. Is a big boat on a trailer in a designated parking spot somehow less noticeable than a car? To me it's the same as if he would have hit a parked car like GT mentioned..

his fault entirely. he's probably just a little steamed. it will take a few days for him to calm dow and look a it from an alternative perspective, and realize it was his fault. i deal with these people all the time at traffic collisions. they get realy quick to point the finger at someoe else util they realize the truth. some people will say they were out of line and apologize, some are too stubborn to drop there ego and will just avoid it. dont stress tom.
oh btw, i would arrive to work with a ginormous smile on my face every day if thats where i parked for work. ur a lucky guy! ;D

My good friend had a business and something similar happend. You have a well established business people know where you are located. That being said fork out the dough 300 maybe 400 body work paint match. The last problem you would want is to have a Pissed Off landlord.

GT hit it. The stalls are allotted to tenants for retail customers. If the boats take up all your stalls, that means any drive in customer you have would be parking in another tenant's stall...which I am sure is a violation of your lease, and technically the zoning code as it relates to on-site parking...and if you are dealing with a nutbag landlord, and don't smile, swallow and fix his truck I would start looking for another place. Picture the scene in Tombstone just the moment before the fight at the corral starts.
I am sure you have seen him act out on other tenants.

I would look over your lease and see what it says about your parking allotment. i hate people that do not want to take responsibility for thier actions........... I wouldnt offer to pay for any of it UNLESS he becomes demanding and flat asks you to. Offering to pay admits liability!

The other side of the coin is that in this economic climate NO ONE is going to get a lease on a building to start up a new business. He may boot you, if he is stupid, because if he does it is going to take at minimum 6-12 months the fill the vacancy you leave and i am sure you are paying more then $500 a month! If he demands you to pay up, I would simply state that you will no longer be a tenant in his building upon the completion of your current contract! I am sure you can find a more suitable and larger building for less money in this current economic situation this country is in. Dont cave in to worthless pieces of crap that expect everyone to pay for their careless actions!

Thanks everyone , Like "Kellys Court on Fox" This is my approach , I rent 4 buildings (everyone else has one maybe two) and not only have been there almost 15 years but I pay my rent on time , watch over the place (surveilance) and We do our best to follow all their rules , in this economy tenants are "dropping like trousers in a brothal" , I told him I'll scout for a used roll pan and at my convenience install it , I got him to pay for the "fried" cams, and re-install them (his worker,not mine) I also put up red cones at the hitch heads and strung "crime scene tape around everthing . The way I see it he backed carlessly into something of mine that was parked in the alotted and agreed upon spots PLUS this was nothing new they've been there forever , a few years ago I "knarfed" the side of my truck on a pallet full of lumber in a lumber yard , I was pissed but it was my fault , Rhonda backed my truck into a boat a few months back at the house ,her fault !. When a person backs over a bike or ?? in a driveway or "kisses a parking pole or scarfs thier front roll pan on a cement bumper at Circle K Its Thier fault ! Its the drivers responsibily to know whats behind ,in front or side to side etc, its different if a muffler falls off your truck on the LA freeway and I can't miss it and IMO he needs to be more careful Tom

Hey Tom,
You sound like a pretty good stand up guy, and you do keep a pretty maintained lot, however judging from the photo, some tongues of your trailers are hanging over "limit line" provided in each stall just my .02....
Unless you are ready to get a rate hike in your next lease or perhaps another "tongue" lashing from the guy I personally would try to work out something with him.
I would let him know he shares an equal amount of contributory negligence in the matter, open and obvious for the last 14 years. Are there any signs posted or listed in your lease "park head in first, no backing into stalls" LOL...just a thought.

TG ,words of wisdom and food for thought , the reason the boats are parked the way they are is so'as the Vid surveilance can keep and eye out , Docs cool now till next time (I hope ) you almost got to be a "fly on the wall" to observe the way the LL's mind works , fortunately too (for us I have a new second shop ,three acres in the country and a "fall back plan" ;)! As you can probably tell from my Moniker on here I am a cowboy and I just remembered something that happened to me about 10 years ago. I was working in Houston and lived on a ranch ($500 per month rent) and my two horses were in a 8 acre pasture and the land lord had his horse trailer in there and left the tack compartment open. My younger horse was curious as could be and went up there and took a blanket out if it and basically ruined it. The land lord was pissed and so I agreed to give him a new blanket ($125) to be nice but told him that he was at fault for leaving the door open (backing into a parked trailer). About a month later the exact same thing happened and the land lord came after me complaining about my horse ruining another blanket and demanded that I pay for another one. I said, alright on pay day next week. I started my search for a new place to live and moved out. It took him another year to find a replacement roommate. His lack of responibility cost him $6000 because he demanded that I pay for his own actions! To say that he was pissed was an understatement but hopefully a lesson learned!

Funny story !! , horses are worse than bored dogs , mine used to "crib" (eat for you city folks) the corral fences clean thru even creosote an bitter apple didnt work I use to get so mad I shot them in the ass with a BB gun , (shouldn't admit that) Tom

One of my friends used to keep their horses at my place and he had a horse that had a different form of Cribbing. That damn horse would choke himself on the fences until he would practically pass out. It was the craziest thing you have ever seen! You should teach your land lord how to crib, lol!

Just keep those cameras pointed out in the parking lot so when one of those loaders hits a boat you have proof. Spray the dirt down once and while and hopefully it wont be so dusty. Good luck Tom
