I'm at work so I gotta make this quick.....I am hearing that they have or are making it Zero Tolerance on the River?? :-[ :'( As in NO ALCOHOL on the boat at all....PERIOD! :mad: Is this true???? Tracy

if anything...i dont think its zero alcohol on the boat....it means they are being VERY stern with their alcohol laws with the drivers.....even if you dont blow a .08, you can still go to jail if you appear to be impaired.
just be safe and smart guys....i hate reading about fatalities.
i wont be drinking on the water this weekend at all....you can quote me on that.
when the boat is on the trailer, thats a different story ;)

I never drink when I'm away from home. Seen too many accidents. Plus I carry my .45 when we go out. Like to have it for snakes (the slithering kind and the two legged version lol).

And you wonder why they talk soo much about gun control ::)
Remember some waters are FEDERAL, carry your gun.....go to jail do not pass go , do not collect bail money ;D

K, Guy's.... I don't know how ya'll can find this out for sure,but apparently one of my daughter's friends got popped for a BUI this weekend at Havasu and this Law is supposedly what the cop told him now is in effect! So...I guess we gotta find out some how :-\ :mad:

AZ Fish & Game website has pdf of the standard pamphlet which says .08. Looks old maybe no update. Then I went to Yuma Co. Sherriff Dept. website and it list penalties $2500 and up to 6 mo. but no mention of BAC levels.

Well..the BAC was'nt my concern...Supposedly,they are allowing NO ALCOHOL IN THE BOAT regardless of age,that is what we need to find out. This is what the arresting officer told him is the "new law"! :banghead: :mad: ???

i think your daughters friend might have wrongly interpreted what the cop was saying...
the term "zero tolerance" to me is just a catch phrase used by the cops to say "we arent going to put up with anything"....there is no law (CA or AZ that says you cant have alcohol on the boat...not even sure if theres an open container law similar to like they have for cars.....
i did some searching of the local papers and found nothing of the sort. There was just one article saying they are going to allow drinking in the channel on the beach up to the walkway. This is significant because technically you arent allowed to drink in the city parks.
also, i did also read that they are going to "RESTRICT" access to the sand bars......if ya read between the lines, that means they are just going to pratol it and shut it down if it gets out of hand.

call LHPD and find out.....i dont see this "new law" anywhere.

It's the Law: On the Water
Alcohol and Drugs
Arizona law prohibits anyone from operating a power-driven vessel while under the influence of alcohol or any drug that causes the person to be even slightly impaired. Alcohol and drugs cause impaired balance, blurred vision, poor coordination, impaired judgment, and slower reaction time. Alcohol contributes to nearly one-third of all fatal boating accidents nationwide.
A person is considered to be operating under the influence (OUI) of alcohol if he or she has an alcohol concentration of 0.08% or greater as determined by a test of his or her breath, blood, or urine. "Extreme OUI" is blood alcohol concentration (BAC) of 0.15% and higher.
If convicted of OUI or "Extreme OUI," a person can be fined up to $2,500 and jailed for up to six months. Subsequent convictions and "Aggravated OUI" may carry even more severe penalties.
By operating a vessel on Arizona waters, you have consented to be tested for alcohol or drugs if arrested by a law enforcement officer for alleged violations under Arizona Watercraft Statutes.
The best thing you can do for your safety and the
safety of other boaters is simple...
Don't drink and boat!

BUI Zero Tolerance
Have you ever heard of BUI? That stands for Boating Under the Influence, and it can lead to dangerous conditions on the water. Whether you are operating a canoe, fishing boat or yacht, you can be arrested if you are found to be under the influence or drugs or alcohol.
Alcohol affects people differently on the water than on land. If you are in a boat, you are probably in the sun. The heat, the glare from the water, the noise of the engine and the vibration of the boat can lead to a condition known as “boater’s hypnosis”. This condition can cause fatigue naturally. It can also intensify the effects of alcohol.
It is illegal for people over the age of 21 to drink and drive if their Blood Alcohol Content (known as BAC) is over a certain limit. This limit is .08% in most states. While adults can be arrested if their BAC limit is lower and their driving is impaired, they will not necessarily be arrested.
But because people under the age of 21 are not allowed to drink, they can be arrested for having any alcohol in their system at all. This is known as the Zero Tolerance law. If they are found guilty of drinking and driving, their driver’s license will be suspended for at least 6 months.
The same is true of boating while under the influence of alcohol. Even though you are not on a road, you can still be pulled over and asked to submit to a field sobriety test and a chemical test to determine your BAC level.
What if you refuse? When you received your driver’s license, you signed an agreement saying that you will take a chemical test (breath, blood or urine) if you are suspected to be under the influence while driving. This is known as “Implied Consent”. It also applies if you are operating a boat.
If you are under 21 and are convicted of operating a boat with any alcohol in your system, you will not only lose your license, but you will also be subject to heavy fines. If you have been accused of DUI, you will need to seek advice from proficient and trained DUI lawyers.
Boating under the influence and driving under the influence are both very serious charges.

I understood that California laws allow open containers and drinking in a boat by anyone who is of age and NOT DRIVING. Just holding a beer while driving could get you a DUI as the officer might interpret that as an imparement of judgement. While I know I have been guilty in the past, I will never drink and drive again.
